Resolution

The following resolution was passed unanimously by the Gilbert City Council at its May 20th meeting. Click here for Iowa code on how a council vacancy is to be filled, and click here for publication requirements.

CITY OF GILBERT, IOWA 

RESOLUTION 391

Exercising authority to fill city council vacancy by appointment
and directing publication of notice.

BE IT RESOLVED by the City Council of Gilbert, Iowa:

1. The City clerk received and filed on 23 April 2002 a letter of resignation of City Council Member Helen D. Gunderson dated 23 April 2002, which was effective immediately. Pursuant to Iowa Code section 69.7, the City Clerk forwarded said resignation to the city Council. Said resignation creates a vacancy in the office of city council member at-large with an unexpired term ending 31 December 2003, which must be filled pursuant to Iowa Code section 372.13(2).

2. The City Council hereby opts to fill said vacancy by appointment as provided by Iowa Code section 372.13(2)(a). The City Council proposes to appoint Jonathon Popp to fill said vacancy at the next regular City Council meeting on 3 June 2002.

3. The City Clerk is authorized and directed to publish notice of the City Council's election to appoint to full said vacancy in accordance with sections 372.13(2)(a) and 362.3 of the Iowa Code.

4. The City Council fins this resolution appropriate and necessary to protect, preserve, and improve the rights, privileges, property, peace, safety, health, welfare, comfort, and convenience of the City of Gilbert and its citizens, all as provided for in and permitted by section 364.1 of the Code of Iowa (2002).

5. All other resolution or parts of resolutions in conflict with this resolution are hereby repealed. If any part of this resolution is adjudges invalid or unconstitutional, such adjudication shall not affect the validity of the resolution or action of the City Council as a whole or any part thereof not adjudged invalid or unconstitutional. This resolution shall be in full force and effect from and after the date of its approval as provided by law.

APPROVAL BY MAYOR

           The foregoing Resolution having been adopted this date by the City Council, I hereby approve the same by affixing my signature as Mayor on 20 May, 2002.
